Membership Program Disclosure and Limitations

Cooling By Design offers optional HVAC and maintenance membership programs that may include seasonal maintenance visits, priority scheduling, discounts, and other member benefits. Membership eligibility, benefits, availability, and scheduling are subject to specific service area limitations, capacity constraints, and operational considerations.

Members acknowledge that participation in a membership program does not guarantee emergency service availability, that HVAC systems may still malfunction due to age, wear, manufacturer defects, improper prior installation, natural causes, environmental conditions, or other factors beyond Cooling By Design’s control, and that membership does not substitute for manufacturer warranties or guarantees.

Cooling By Design is not responsible for pre-existing equipment defects, concealed or undocumented equipment issues, power surges, acts of nature, natural disasters, or other circumstances outside the scope of routine maintenance. Membership benefits and terms may be amended from time to time, and such changes will be communicated in accordance with applicable law.

Third-Party Financing Disclosure (Wells Fargo and Other Providers)

Cooling By Design may offer promotional financing options through third-party lending partners, including Wells Fargo and other finance providers. Financing is provided exclusively by the lender, and approval is subject to the lender’s credit standards and policies. Cooling By Design is not a lender or creditor and does not make decisions regarding credit approval, interest rates, fees, repayment terms, credit reporting, account servicing, or penalties.

Customers seeking financing understand that all financing decisions, account statements, billing, and credit reporting are administered strictly by the third-party lender. Cooling By Design shall not be liable for any decisions, disputes, delays, errors, denials, fees, collection actions, or any other outcome relating to a financing agreement. All financing agreements are legally binding between the customer and the finance provider.
